If you have any questions or concerns about whether using an electronic cigarette is right for you, we strongly recommend you discuss any questions or concerns with your doctor before use.

Talk to your doctor before using a JAC Vapour e-liquid if any of the following apply to you:

You are in hospital because of heart disease (including heart attack, stroke and problems with your heart rate or rhythm).
If you have a stomach ulcer, duodenal ulcer, irritation or inflammation of the stomach or throat.
If you have liver or kidney problems.
You have a long-term throat disease or difficulty breathing due to bronchitis, emphysema or asthma. If you have an overactive thyroid gland or have a phaeochromocytoma (a tumour of the adrenal gland that can affect blood pressure).
You have diabetes - Nicotine may affect your blood sugar levels.

If you are pregnant or breast feeding:

We do not recommend the use of JAC Vapour e-liquid by people who are breast feeding or pregnant.
If you wish to use an electronic cigarette whilst breast feeding or pregnant, we strongly recommend you discuss this choice with your doctor prior to use.

You may experience unwanted effects as you reduce the amount of nicotine in your body, either by stopping smoking or using an electronic cigarette. These effects include:

Irritability or aggression
Increased appetite or weight gain
Feeling low
Urges to smoke (cravings)
Anxiety
Nighttime awakening or sleep disturbance
Restlessness
Lowering of heart rate
Poor concentration

If you are taking any medicines prescribed by your doctor on a regular basis

If you are taking any medicines and wish to use an electronic cigarette, we strongly recommend you discuss this with your doctor or pharmacist prior to use.

In particular, you should tell your doctor or pharmacist if you are taking any of the following medications:

Theophylline (used to treat breathing problems)
Clozapine (used to treat schizophrenia)
Ropinirole (used to treat restless legs)
Stopping smoking or cutting down slows your metabolism. Your doctor may need to change the dose of these medicines.

Nicotine

Many of our e-liquid products contain nicotine (EC 200-193-3). Nicotine is toxic and can cause serious harm if ingested.

JAC Vapour e-liquid is only to be used to refill e-cigarettes – follow the refill instructions for your device to ensure no accidental leakage or spillage occurs. Clean any spillage immediately with warm soapy water. If you swallow e-liquid, or spill e-liquid on your skin and feel unwell, please call NHS 111 for advice without delay.

Possible Side Effects

Using electronic cigarettes can cause side effects, although not everybody experiences them. As many of the side effects are due to the consumption of nicotine, they can also occur when you consume nicotine by smoking. Many people do not suffer side effects (Farsalinos, KE et al. Int. J. Environ. Res. Public Health 2014, 11, 4356-4373).

Typical reported mild temporary side-effects include:

Throat/mouth irritation
Gingivitis
Cough
Headache

If you are using a nicotine-containing e-liquid, it is possible to consume too much nicotine if you use your electronic cigarette too often. You may also experience these effects if you are not used to inhaling when you smoke tobacco.

These effects include:

Feeling faint
Feeling sick (nausea)
Headache
Salivation
Pain in your abdomen
Diarrhoea
Sweating
Dizziness
Hearing disturbance
Weakness

Reporting of side effects

If you experience any side effects, talk to your doctor, pharmacist or nurse. This includes any possible side effects not listed in this booklet.

You can help to make sure that electronic cigarette products remain as safe as possible by reporting any unwanted side effects via the internet at mhra.gov.uk/yellowcard. Alternatively, you can call Freephone 0808 100 3352 (available from 10 a.m. to 2 p.m. Mondays to Fridays) or fill in a paper form available from your local pharmacy.

Addictiveness and toxicity

This product may contain nicotine which is a highly addictive substance. However, considering the intended use and the toxicological profiles of the ingredients, this product is not likely to cause any hazardous health effects in the majority of consumers when used as directed.

E-Cigarettes and Children

Always keep your JAC Vapour e-liquid out of sight and reach of children and dispose of carefully.

Your JAC Vapour e-liquid container has a number of small components which may pose a choking hazard if a child attempts to ingest them.

Nicotine can be very dangerous to small children and can sometimes be fatal. Nicotine ingestion by a child may cause severe poisoning.

If your child accidentally uses, sucks on, or chews on a component which contains e-liquid, you should take them to your nearest accident and emergency department immediately.

If your child has accidentally ingested or has come into contact with any e-liquid, you should take them to your nearest accident and emergency department. Ensure that you take the e-liquid packaging and information booklet with you if possible.

TERMS OF USE

1 - Overview

This website is operated by Magflo Ltd trading as JAC Vapour, a limited company registered in Scotland under company number SC630828. Throughout the site, the terms “we”, “us” and “our” refer to JAC Vapour. JAC Vapour offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

6 - Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

1 - Overview

These Terms and Conditions, together with all information and documents referred to in them, govern all sales of products ("Products") by us through this website (the "Website" “Site”) to you.

BY PLACING AN ORDER FOR A PRODUCT THROUGH OUR WEBSITE, YOU AGREE TO AND ACCEPT THESE TERMS AND CONDITIONS.

To register with and purchase Products via the Website, you must be aged 18 years or over.

We may amend these Terms and Conditions from time to time. Every time you order a Product, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 24 April 2020.

Your use of our Website is governed by our Terms of Service. Please read these as they include important terms that apply whenever you visit this Website.

2 - Orders and Payment

You may place an order for Product(s) via our online Order Process – instructions for which are set out on our website. Before submitting your order you should check carefully and amend any errors. At the end of the process you will be asked to provide payment through your chosen online payment method – we accept card payments through SagePay and PayPal. Your order will be considered submitted once you have made your payment through your chosen payment method. By submitting your order you authorise us to immediately charge your payment card for the purchase price and we are entitled to rely on you submitting an order as an instruction to us to take your payment. Your submitted order represents an offer to us to purchase the Product(s).

Once you have placed your order we will send a confirmation email to you confirming the Product(s) ordered, the price, and the delivery address. The confirmation email represents our acceptance of your order subject to these Terms and Conditions.

If we are unable to accept all or part of your order, we will inform you of this and will not charge you for the rejected part of your order. This might be because the Product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the Product or because we are unable to meet a delivery deadline you have specified. If you have already made payment when we reject your order, we will return the money paid for the rejected part of your order via your original payment method.

All Products shown on the Website are subject to availability. We will inform you by email as soon as possible if the Product you have ordered is not available and will not process your order.

3 - Prices

Unless otherwise stated all prices are in Pounds Sterling and are inclusive of VAT. Delivery charged will be indicated to you at the time of ordering and will be added to the purchase price before you confirm your order.

The price of a Product is as published on the Website at the date we accept your order. Prices are subject to change without notice at any time, but changes will not affect any order that we have previously accepted. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect.

It is possible that, despite our reasonable efforts, a Product on our Website may be incorrectly priced. If we discover an error in the price of a Product that you have ordered we will inform you of this error and give you the option to continue with your order at the correct price or to cancel your order. If you do not respond to us within 7 days, we will treat the order as cancelled and notify you in writing.

4 - Delivery

Delivery timescales may vary dependent on your chosen delivery method and the location of the delivery address.

Unless agreed otherwise in writing we will deliver the order to the delivery address stated in your submitted order. We accept no liability for orders not received due to an error in the delivery address provided by you in your submitted order.

We will indicate our estimated dispatch and delivery timings on the Website. Please note that the dispatch timings indicated on the Website are estimates only. The timings are not guaranteed times. We will send you an email confirming when your Product has been dispatched which will be within 30 days after the date on which we accept your order.

If our supply of the Products is delayed by an event outside our control we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. However, if your order is lost in transit, please notify us and we will resend your order to you at no additional cost. We may, at our reasonable discretion, require proof of non-delivery, such proof to be obtained at your cost.

If no one is available at your address to take delivery and the Products cannot be posted through your letterbox, the delivery provider will leave you instructions informing you of how to rearrange delivery or collect the Products from a local depot.

If you do not re-arrange delivery or collect the Products from a delivery depot we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract.

5 - Returns and Warranty Periods (UK and EU Orders)

The following clause is applicable only for customers who have purchased their products from within the UK or EU.

If you decide to return the products within our 14 day ‘No-Quibble’ Returns period we will provide a full refund for the returned Products. To exercise your right to return products under our ‘No-Quibble’ returns policy you must ensure you notify us in writing within 14 days of receiving your Products.

Under the 14 day ‘No-Quibble’ Returns policy we are unable to accept returns of any Products sealed for health protection or hygiene purposes, once these have been unsealed after you receive them - this includes but is not limited to E-Liquid and Tank Products.

If you would like to return a Product because you believe it has developed a fault please contact the customer service team at sales@jacvapour.com and we will provide you with instructions for returning the product to us for inspection. Upon our receipt and inspection of the returned Product, we reserve the right to determine whether, in our opinion, it is faulty or not.

If we agree that the Product is faulty, and that the fault has developed during the Warranty Period through no fault of your own we will, if possible, repair the product and return the product to the delivery address. Given the nature of the Products, it may not always be possible to repair the Product. In this situation we may at our sole discretion provide a refund or a replacement Product to you. In the case of the Product no longer being available, we may choose to replace it with a similar Product of the same or greater value – in this instance the value is determined by the current Product price at the time of the replacement. If the Product is repaired or a replacement is issued the applicable warranty period for the original Product still applies.

We accept no liability for any Products which have developed faults or defects due to:

Wear and tear expected under normal usage conditions.
Damage caused by impact, fire, theft, attempted theft, accidental or malicious damage, vandalism, corrosion or water contamination.
Improper usage, storage or handling of the product.
Damage or defect due to wilful neglect or negligence.
Loss of quality, degradation of performance or actual damage that results from the use of third-party hardware or e-liquid which are neither manufactured or approved by JAC Vapour.
User modification of any of our hardware.
Connection of third-party accessories or hardware to the product which have not been approved by JAC Vapour.
External causes outside of our control which may include accidents, fire or theft.
Unless agreed otherwise in writing you are responsible for the cost of returning Products to us and we will not refund any cost incurred in relation to products being returned to us by you for inspection, repair, refund, or replacement.
Replacements, repairs, or refunds in relation to a Product which has developed a fault outside of the warranty period are at our sole discretion.

The warranty period applies from the date of dispatch and is not transferable to a third party.

6 - Returns (International Orders – Non-EU)

We accept no liability for any Products which have developed faults or defects due to:

Wear and tear expected under normal usage conditions
Damage caused by impact, fire, theft, attempted theft, accidental or malicious damage, vandalism, corrosion or water contamination
Improper usage, storage or handling of the product
Damage or defect due to wilful neglect or negligence
Loss of quality, degradation of performance or actual damage that results from the use of third-party hardware or e-liquid which are neither manufactured or approved by JAC Vapour
User modification of any of our hardware

External causes outside of our control which may include accidents, fire or theft

Unless agreed otherwise in writing you are responsible for the cost of returning Products to us and for us re-sending the repaired or replacement Product to the delivery address. We will not refund any cost incurred in relation to products being returned to us by you for inspection, repair, refund, or replacement, nor will we refund any cost incurred in re-sending the repaired or replacement Product to the delivery address.

Replacements, repairs, or refunds in relation to a Product which has developed a fault outside of the warranty period are at our sole discretion.

The warranty period applies from the date of dispatch and is not transferable to a third party.

8 - Liability

We will not be liable for lost profits, loss of business or other consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein.

You agree that for any liability related to the purchase of products or services, we are not liable or responsible for any amount of damages above the aggregate amount paid by customer for the purchase(s) under this agreement.

9 - Additional Terms

We may transfer our rights and obligations under these Terms and Conditions to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract. You may only transfer your rights or your obligations under these Terms and Conditions to another person if we agree to this in writing.

This contract is between you and us. No other third-party shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other third-party in order to end the contract or make any changes to these Terms and Conditions.

Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

If we do not enforce any of these terms immediately, or if we delay in taking steps against you in respect of your breaking this contract, you remain bound to, and agree to fulfil any obligations arising from, these terms and we reserve the right take action against you at a later date.

We may change, modify or revise these Terms and Conditions at any time. Any changes made to these Terms and Conditions will apply on the date we post the modified terms on our Website. These changes will only apply to orders placed on or after the date on which the changes to the Terms and Conditions take effect. It is your responsibility to check that you have read and agree with the latest Terms and Conditions on the Website.

10 - Governing Law

This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with Scottish Law.
